TORONTO — An appeal of Ontario's legislation banning pit bulls in the province will be heard in the Court of Appeal next week.
In late March, the provincial government claimed victory after the controversial law survived a constitutional challenge. But a Judge did change the law in two ways by ruling the ban on "pit bull terriers" fails to refer to a specific type or breed of dog.
Superior Court Justice Thea Herman also ruled against letting the province rely on vets to identify those dogs captured by the law.
Lawyer Clayton Ruby, who led the challenge, argued the ban is unconstitutional and too broad because it bans all pit bulls.
He says the two earlier victories were "not enough" and appealed Herman's decision to the Court of Appeal for Ontario. The Attorney General's office cross-appealed and all appeals will be heard next Monday and Tuesday."

Wouldn`t being a member of the same species qualify as "substantially similar"?

Is that a dog with a certain look or a dog with certain genetics?

Be Proactive
Ask your Municipality if your dog is an Ontario Gov`t 'pit bull' and get the answer in writing on their letterhead
No decision says it all.
It means that they don`t have a clue which dogs are subject to the Legislation
Only the Owners of the 3 named recognized Breeds know that they own a Gov`t 'pit bull'.
People might be very surprised at the look of some of the dogs that are being tagged as Gov`t 'pit bulls' in Ontario.
This might be an eye opener for some!
I requested a written designation from my Municipality on my dog
(due to Munchie`s story-see below)
She`s a mix breed dog
Here`s her picture
and here`s their response.
Thought this would be an easy one for them
(They didn`t even want to hazard a guess)
If they are unable/unwilling to state in writing that THIS dog is NOT a Gov`t "pit bull",then be very,very afraid Ontario Dog Owners!
These are the people who are expected to enforce this Legislation.

"Munchie" was killed
after a Court took the opinion of an unqualified Shelter Worker
(who identified it as an Ont. Gov`t 'pit bull' on behalf of the Ont. Gov`t)
over a CKC Judge who identified it as "a mongrel that most resembles a field Labrador"
It was alleged to have bitten,being tagged a 'pit bull' sentenced it to death.
If you own one of these Breeds
(only 1 'Pit Bull' Breed in this group)
or a mix with "the look" you definitely better get it in writing
before taking your unmuzzled dog for a walk.
Other Pure Breeds are not excluded from this Legislation!
If you own a mix breed
that doesn`t have the look, you should still ask and get it in writing especially if it happens to look like a Field Labrador
or one of the other mutts that have been picked up and tagged 'pit bull'
All I want from Gov`t(Municipal or Provincial) is a simple letter stating whether or not my mix breed dog is a Gov`t 'pit bull'
